Good Samaritan's wife sues family of woman he tried to help

WEATHERFORD, Texas — The family of a Good Samaritan who was killed when he stopped to help a pedestrian hit by a car is suing the woman's family and the bar that allegedly over-served her alcohol that night.

The lawsuit claims 30-year-old Amanda Leann Edwards created a dangerous situation by walking out into traffic on Interstate 35 in Burleson, Texas, after a night out at Fort Worth bars in April 2012.

Gene Howard saw Edwards get hit by a minivan, and stopped to help, along with the driver of the minivan. But Howard was struck by a pickup truck and killed.

Howard’s widow, Tina Howard, is seeking $1 million in damages in the lawsuit, which was filed in Tarrant County in May. The suit also names John Morell, the driver who struck Howard, and Electric Cowboy, where Edwards had been drinking earlier in the night.

The Electric Cowboy denies it over-served Edwards and says it was not responsible for the accident.

Attorneys for Morell and Howard could not be reached Thursday.

"This is too much," said Lynnda Whitaker, Edwards' mother. "To me it's cold and heartless. Her husband might have been a victim, but so was my daughter."

Whitaker said her daughter had been out with her best friend that night, but the family still doesn't know how or why Edwards ended up in the middle of the highway, alone, on foot, and without her cell phone.
