Appeals court upholds life terms for Maxwell, but removes stacking of sentences

In an opinion handed down Thursday, the Second Court of Appeals in Fort Worth upheld the convictions and life sentences a Parker County jury assessed to Jeffrey Maxwell for the aggravated kidnapping and aggravated sexual assault of a 62-year-old woman.

In the 2012 trial, jurors heard evidence how Maxwell violently kidnapped the woman from her Whitt home, bound her at gunpoint, took her to his Corsicana area home and sexually assaulted her while she was hanging from a deer-skinning device. He then held her for about 12 days, keeping her chained up during more sexual assaults and, at one point, putting her in what she described as a coffin in his garage.

Maxwell returned to the woman's home and burned it to the ground.

She was finally located when Maxwell deposited a check the woman wrote him and the woman's banker, knowing she was missing, contacted police. When police arrived, she was fortunate enough to not be chained up and came running out the front door exclaiming "I'm here, I'm here."

The appeals court did unstack Maxwell's life sentences, at the request of state prosecutors, setting the life terms to run concurrent.

"The court's ruling was exactly what we had expected and hoped it would be," said Parker County Assistant District Attorney Jeff Swain. "This is just one more step to assuring that Jeffrey Maxwell will spend the rest of his life in prison, which was our goal from the outset of the prosecution of this case. He still has the right to appeal this ruling to the Texas Court of Criminal Appeals if he chooses to do so."

The Democrat will have more on this story.
