The former Weatherford College library director is suing the college, claiming she was terminated after 35 years with the district because of her age.
Martha Tandy filed a lawsuit against Weatherford College earlier this month, claiming age discrimination, violations of the Texas Constitution and breach of contract. She is seeking damages of more than $200,000.
According to Tandy, she was approached in January by the college and informed she could retire or would be terminated.
She was told she was being asked to retire due to “deficiences” in her job performance, specifically due to the results of an audit of the library’s assets, according to the lawsuit petition.
“The audit results had not yet been reconciled due to understaffing and lack of support from the business and accounting personnel of the college,” the petition states.
Tandy claims the issues were just pretexts for terminating her based on her age.
Tandy said she requested a due process hearing on Feb. 5 but the college denied her request and, on Feb. 7, terminated her.
She was 63 years old at the time and was making an annual salary of nearly $73,000 as the library services
director, a position she held since 1992.
At the time of her termination, she was serving as the chair of the Texas Council of County College Librarians, according to the lawsuit.
After filing an age discrimination complaint with the Texas Workforce Commission the following month, the commission issued her a right to sue letter, the petition states.
Weatherford College declined to comment on the lawsuit or answer questions about the audit because the issues involved personnel matters and ongoing litigation.
In response to a request by the Democrat for a copy of the audit and related documents under the Texas Public Information Act, the college declined to release the records Wednesday, stating they would be requesting a Texas Attorney General opinion because the document involves ongoing litigation.
