Shooting draws 5-year prison term


A Western Lake Estates resident who shot another man who was attempting to break up a fight was sentenced to five years in prison.

Gary Lee Martin, 26, pleaded guilty to aggravated assault with a deadly weapon earlier this month regarding the June 26 shooting of a 48-year-old man.

“We discussed the plea offer with the victim and the victim was fine with the plea offer being the sentence imposed,” Assistant District Attorney Jeff Swain said.

Swain said they believe it was more of a reckless situation rather a situation where Martin set out to shoot the victim.

The men knew each other and the victim was injured when he stepped into the middle to stop a fight, according to Swain.

“Functionally, our victim was a peacemaker and ended up getting shot,” Swain said. “He had some pretty lasting injuries as a result.”

All of the parties involved had been drinking and were highly intoxicated at the time of the shooting, Swain said.

The shooting occurred in the 200 block of Tumbleweed Drive in front of Martin’s home, where  deputies found the 48-year-old man lying on the ground with a gunshot wound to the stomach when they responded around the residence late the night of June 26, according to the Parker County Sheriff’s Office.

Martin reportedly fled the area after the shooting, initiating a manhunt that included a DPS helicopter before surrendering to authorities around 5 a.m. the next day after returning home.

Martin has been held in the Parker County Jail since his arrest, according to jail records.
